21. Contact Us
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with any separate client agreement, are the entire agreement between you and us regarding this website and our Offerings.
20. General
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continuing to use the site after changes are posted means you accept the updated Terms.
19. Changes to These Terms
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. If a dispute arises, we both agree to first try to resolve it informally by contacting each other in writing. If we can’t resolve it within 30 days, any legal action must be brought in the state or federal courts located in Harris County, Texas.
18. Governing Law and Disputes
Your use of this site is also governed by our Privacy Policy, which explains how we collect and use your information. [Privacy Policy]
17. Privacy
We may suspend or end your access to this website or any Offering, without a refund, if you violate these Terms, misuse our content, or treat our team or community members with disrespect.
16. Ending Your Access
You agree to defend and hold harmless The Ashmore Collective, LLC, its owner, team members, and contractors from any claims, damages, or expenses (including reasonable attorneys’ fees) that arise from your use of the site or Offerings, your violation of these Terms, or your violation of anyone else’s rights.
15. Indemnification
To the fullest extent allowed by law, The Ashmore Collective, LLC, its owner, team members, and contractors will not be liable for any indirect, incidental, special, or consequential damages, including lost profits or lost data, arising from your use of this site or any Offering. Our total liability for any claim will not exceed the amount you paid us for the Offering in question during the 12 months before the claim.
14. Limitation of Liability
This website and our Offerings are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee the site will always be available, error-free, or free of viruses.
13. Disclaimer of Warranties
This site and our Offerings may link to or use third-party platforms, tools, or products. Some links may be affiliate links, which means we may earn a commission at no extra cost to you. We only recommend things we believe in, but we aren’t responsible for third-party products, services, or websites, and your use of them is subject to their own terms.
12. Third-Party Tools and Links
Nothing on this site or in our Offerings is legal, financial, tax, accounting, or medical advice. Please consult a qualified professional for advice specific to your situation.
11. Not Professional Advice
Our Offerings are educational and strategic. Your results depend on your effort, your business, your market, and many factors outside our control. We don’t guarantee any specific income, growth, clients, or outcomes. Testimonials and examples reflect real experiences but are not typical or promised results.
10. No Guaranteed Results
If you submit testimonials, comments, questions, or other content to us or in our community, you keep ownership of it. You give us permission to use what you submit publicly to us (such as testimonials and feedback) in our marketing, with your first name or business name, unless you ask us not to. We’ll never share anything you’ve told us in confidence.
9. Content You Share With Us
Everything on this website and in our Offerings, including text, frameworks, graphics, videos, templates, logos, and brand names, belongs to The Ashmore Collective, LLC or is used with permission, and is protected by copyright and trademark law. You may share links to our content and quote short excerpts with credit to J.D. Ashmore. Anything beyond that requires our written permission.
8. Intellectual Property
All purchases made through this website, including digital products, paid community memberships, and programs, are final. We do not offer refunds, exchanges, or credits, including for partial use, non-use, or change of mind. Please review each Offering carefully before purchasing and email us with any questions beforehand.
Payment Disputes. By purchasing, you agree to contact us at [email protected] to resolve any billing concern before filing a chargeback or dispute with your bank or card company. Filing a chargeback without first contacting us may result in immediate loss of access to all Offerings.
7. All Sales Final
This section applies to one-time strategy sessions, intensives, VIP days and similar services, such as The Direct Line (“Session Services”). The length, format and deliverables of each Session Service are described on its offer page or proposal.
Agreement at checkout. When you check the box confirming you agree to these Terms and complete your payment, you enter a binding agreement for the Session Service you selected. No separate signed contract is required unless we send you one.
Payment and booking. Session Services are paid in full at booking. Your date is not reserved until payment is complete.
Preparation. Some Session Services include an intake form or other prep. Prep is due [48 hours] before your session so we can come prepared. If it isn’t received in time, your session will be moved to the next available date.
Rescheduling. You may reschedule [once] with at least [48 hours’] notice. Rescheduled sessions must take place within [30 days] of your original date. Requests made with less notice may not be accommodated.
Late arrivals and no-shows. Sessions end at their scheduled time, even if they start late. If you are more than [15 minutes] late without notice, the session is considered a no-show. No-shows are forfeited and are not refunded or rescheduled.
Recordings. We do not provide recordings unless the offer page says otherwise. You may record the session for your own personal use.
Deliverables. Any written deliverables, such as plans or checklists, will be delivered within the timeframe stated for that service. Session Services provide strategy and recommendations. Implementation is not included unless purchased separately.
Credits toward other services. If a Session Service includes a credit toward another offer, the credit applies only within the stated window, cannot be transferred, and has no cash value.
Refunds. Session Services are covered by the All Sales Final section of these Terms.
6. Strategy Sessions and Intensives
Submitting an inquiry form or visiting a booking page does not create a contract. Paid services are governed by either (a) a separate client agreement signed by both parties, or (b) these Terms, including the Strategy Sessions and Intensives section, when you accept them at checkout. If a signed client agreement exists, it controls over these Terms where the two conflict.
5. Services and Inquiries
Paid community and program access is personal to you and may not be shared.
Billing. If your membership renews automatically, you authorize us (or our payment processor) to charge your payment method on each renewal date until you cancel. Pricing will be shown at checkout. If a payment plan is offered, you are responsible for completing every payment in the plan, even if you stop participating.
Cancellation. You can cancel a recurring membership at any time before your next billing date by emailing [email protected] or through your account, if available. Cancellation stops future charges. You keep access through the end of the period you’ve already paid for.
Community Conduct. We want every space we host to be one where women founders feel safe to show up fully. By joining, you agree not to harass, demean, or discriminate against other members; not to spam, pitch, or solicit members without permission; and not to share other members’ personal information or content outside the community. We may remove anyone who violates these standards, without a refund.
Confidentiality. What’s shared in our community stays in our community. Don’t screenshot, record, or repost other members’ content without their permission.
Changes to Programs. We may update the content, format, schedule, or platform of any program to improve it. If we discontinue a program you’ve paid for in full before its stated end, we’ll let you know and decide on fair next steps with you.
4. Paid Community and Programs
When you purchase a digital product (such as a template, guide, workbook, or course), you receive a limited, non-exclusive, non-transferable license to use it for your own personal or internal business use. Unless the product description says otherwise, you may not:
Share, resell, sublicense, or distribute the product or your login access
Copy, repackage, or present the product or its contents as your own
Use the product to create a competing product or teaching material
Access to digital products may be delivered by download or through a third-party platform. We aren’t responsible for interruptions caused by those platforms, but we’ll make reasonable efforts to restore access if something goes wrong on our end.
3. Digital Products
When you sign up for a freebie, quiz, newsletter, or other free resource, you agree to receive emails from us, including educational content and promotions for our paid Offerings. You can unsubscribe at any time using the link at the bottom of any email. Free resources are provided as-is and may be changed or discontinued at any time.
2. Free Resources and Email
You must be at least 18 years old and able to enter into a binding agreement to purchase anything or join any program through this site. By making a purchase, you confirm that you meet these requirements.
